- Noncustodial Parent’s Monthly Share of Child Care Expenses
-
The amount of child care expenses for which the Noncustodial Parent (NCP) would
be responsible. You may need to use a formula to determine what this value should
be. Different scenarios in how child care expenses are paid require different formulas.
The share of child care expenses is determined by the percentage of total income,
monthly child care expenses, and the portion already being paid by the party. Detailed
scenarios and formulas are explained below.
When the child care expenses are paid by the Custodial Party(CP), this amount is
calculated as follows:
Line 7 – Total Monthly Income as percentage for Noncustodial Parent
multiplied by
the amount of child care entered
plus
the Basic Child Support Obligation.
For example, the Custodial Party pays $400 per month for child care expenses. The
Noncustodial Parent’s income represents 64% of the total combined income for the
Custodial Party and Noncustodial Parent. To calculate the Noncustodial Parent’s
portion of child care expenses, the following calculation is performed:
$400.00 * 64% = $256.00.
This amount will be added to the Noncustodial Parent’s basic child support obligation.
When the child care expenses are paid by the Noncustodial Parent, this amount is
calculated as follows:
Line 7 – Total Monthly Income as Percentage for Custodial Party
multiplied by
the amount of child care entered
subtract this from
the Basic Child Support Obligation
For example, the Noncustodial Parent pays $400 per month for child care expenses.
The Noncustodial Parent’s income represents 64% of the total combined income for
the Custodial Party and Noncustodial Parent. The Custodial Party’s income represents
36% of the total combined income for the Custodial Party and Noncustodial Parent.
To calculate the Noncustodial Parent’s portion of child care expenses, the following
calculation is performed:
$400.00 * 36% = $144
This amount will be deducted from the Noncustodial Parent’s basic child support
obligation.
When a portion of the child care expenses are paid by both the Noncustodial Parent
and the Custodial Party (expenses can be calculated when there are two or more child
care providers), this amount is calculated as follows:
Child care expenses paid by Custodial Party
plus
Child care expenses paid by the Noncustodial Parent
multiplied by
Line 7 – Total Monthly Income as Percentage for Noncustodial Parent
Deduct the child care expenses already paid by the Noncustodial Parent from the
calculated amount.
For example, there is a total of $500 per month (for all child care providers being
used) required for child care expenses. The Custodial Party pays $400 of this monthly
expense, and the Noncustodial Parent pays $100 per month of this monthly expense.
As shown on line 7, the Noncustodial Parent’s income is 64% of the total combined
income for the Custodial Party and Noncustodial Parent.
To calculate the Noncustodial Parent’s portion of child care expenses, the following
calculation is performed:
$500.00 is the total monthly child care expense.
$500.00 * 64% = $320.00 – this is the Noncustodial Parent’s share of total combined
child care expenses
$320.00 - $100.00 = $220.00 – this is the Noncustodial Parent’s adjusted share of
child care expenses. As the calculation shows, the amount is reduced by the amount
of child care expenses being paid by the Noncustodial Parent
